2. Scope
These terms of use apply to the use of the GoutWatcher website and the GoutWatcher mobile app and all associated functions, content, and optional paid offerings.
3. Description of services
GoutWatcher helps users document personal entries related to nutrition, everyday habits, and their own observations in a structured way and display them clearly.
The app is intended solely for private information, self-organization, and general orientation in everyday life. No medical advice, diagnosis, therapy recommendations, or health monitoring is provided.
4. Not a medical device and no medical services
GoutWatcher is not intended to detect, diagnose, treat, monitor, alleviate, or prevent diseases or health complaints.
Using the app does not replace medical advice or treatment. If you have health complaints, questions about therapy, or other medical decisions, you should always consult qualified medical professionals.
5. Requirements for use
The use of the app requires a compatible device, a supported operating system, and — where applicable — an internet connection.
No guarantee is given for the permanent availability of platforms and third-party providers, in particular the Apple App Store, the Google Play Store, or other technical services.
6. Use at your own risk
The use of GoutWatcher is at your own responsibility. Users are themselves responsible for how they evaluate and use the content, documentation, reminders, or evaluations provided by the app.
No medical or other binding recommendations can be derived from using the app.
7. Paid features and subscriptions
GoutWatcher may offer paid premium features or automatically renewing subscriptions. The specific services, prices, and terms are displayed within the app before purchase.
Available terms may in particular be monthly or yearly. The exact price is determined by the display in the respective store and within the purchase dialog.
Subscriptions renew automatically unless cancelled in due time before the end of the current billing period. Management and cancellation take place via the user account of the respective store provider.
To the extent the purchase is made via Apple, payment is processed via the Apple ID account. To the extent the purchase is made via Google, payment is processed via the Google account.
In-app purchases and subscriptions are processed via external platforms (e.g. the Apple App Store or the Google Play Store). The terms of the respective platform operators apply in addition.
An external service provider (e.g. RevenueCat) may be used for the technical management and validation of subscriptions.
8. Trial periods, offers, and price changes
To the extent trial periods, introductory offers, or discount promotions are offered, the terms displayed before taking advantage of them apply.
Price changes for future billing periods are subject to the terms of the respective platform operator.
9. No specific outcome
No specific outcome is owed. In particular, no improvement of health complaints, no change of personal habits, and no other specific result is guaranteed.
10. Availability and changes
The provider endeavors to make the website and the app available with as few disruptions as possible. However, permanent, uninterrupted, or error-free availability is not owed.
Functions, content, and technical designs may be adjusted, extended, restricted, or discontinued at any time, to the extent this is objectively justified and reasonable for users.
11. Permitted use
The app and the website may only be used within the framework of the applicable laws and these terms of use. In particular, any abusive use, any disruption of technical processes, and any use for unlawful purposes is prohibited.
12. Intellectual property
All rights to the app, the website, and their contents — in particular texts, designs, structures, databases, graphics, trademarks, and other components — remain with the provider or the respective rights holders.
Users are granted only a simple, non-transferable right of use within the framework of these terms of use.
13. Liability
The provider is liable without limitation for intent and gross negligence as well as for damages arising from injury to life, body, or health in accordance with the statutory provisions.
In the event of slightly negligent breach of material obligations, liability is limited to the foreseeable, contract-typical damage. Otherwise, liability for slightly negligent damages is excluded, to the extent legally permitted.
In particular, no liability is taken for the content, hints, documentation, or evaluations provided being suitable, complete, or up to date for personal, health, or other decisions.
14. External services and third parties
The app and the website may integrate technical services and platforms from third parties, such as app stores, hosting, form, communication, or subscription services.
The respective providers are themselves responsible for the content, availability, and terms of such third-party offerings.
15. Privacy
Information on the processing of personal data can be found in the privacy policy: privacy-en.html
16. Term and termination
The use of the free areas of the website and the app is for an indefinite period.
Paid subscriptions continue until effectively cancelled in accordance with the terms of the respective store.
17. Changes to these terms of use
The provider may adjust these terms of use if there is an objective reason, for example due to technical changes, new features, changes in legal requirements, or changes to the business model.
The version published in each case is authoritative.
18. Applicable law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods, to the extent that mandatory statutory consumer protection provisions do not conflict with this.
19. Dispute resolution
The provider is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board, to the extent there is no statutory obligation.
20. Severability clause
Should individual provisions of these terms of use be or become invalid or unenforceable in whole or in part, the validity of the remaining provisions remains unaffected.
